These Terms of Service ("Terms") govern the purchase and use of software packages and related services provided by Auburn Ridge Tech ("we", "us", "our") to you ("Client"). By purchasing a package or using our services, you agree to these Terms.
01 Software license & packages
Auburn Ridge Tech is an authorized software reseller. We provide e-commerce software, marketing automation, and AI tools packaged into defined tiers (Essentials, Professional, and Enterprise), together with implementation and support as described for the tier purchased.
Upon purchase, you are granted a non-exclusive, non-transferable license to use the delivered software for your own business, subject to these Terms and any applicable third-party or platform terms.
02 One-time fees
Package prices are stated as one-time fees for the scope described. Third-party services (such as domains, payment processing, messaging, or hosting where applicable) may carry their own separate charges billed by those providers. Fees are due as agreed at purchase and, once implementation begins, are non-refundable as set out in our Refund Policy.
03 Acceptable use
You agree to use the software and services lawfully and not to:
- Violate any applicable law, regulation, or third-party right;
- Send unlawful, deceptive, or unsolicited communications, or otherwise misuse marketing tools;
- Resell, sublicense, or redistribute the software except as expressly permitted;
- Reverse-engineer, disrupt, or attempt to gain unauthorized access to the platform.
04 Client responsibilities
Successful delivery depends on your timely cooperation. You are responsible for:
- Providing accurate business information, content, and access needed for configuration;
- Maintaining your own accounts, credentials, and any required licenses;
- Compliance of your products, offers, and communications with applicable law;
- Reviewing and approving deliverables during the process.
05 Intellectual property
All underlying software, platform technology, templates, and materials remain the property of their respective owners, including Auburn Ridge Tech and its licensors. Content you provide remains yours; you grant us a limited license to use it solely to deliver the services. Configurations and deliverables produced for you are licensed to you for your business use.
06 Limitation of liability & no guarantee
The services and software are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Auburn Ridge Tech disclaims all implied warranties and shall not be liable for indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the amount you paid for the applicable package.
Auburn Ridge Tech makes no guarantee of income, revenue, sales, profit, or any specific business result. The software and services are tools; outcomes depend on many factors outside our control, including your market, effort, and execution.
07 Refunds
A full refund is available within 72 hours of purchase, provided implementation has not begun. After that, all sales are final. Our "make it right" support commitment (repair or re-deliver) applies as described in the Refund Policy, which is incorporated into these Terms.
08 Governing terms & changes
These Terms constitute the agreement between you and Auburn Ridge Tech regarding the services and are governed by the laws applicable at our principal place of business. We may update these Terms from time to time; the version in effect at your purchase governs that purchase. If any provision is unenforceable, the remainder stays in effect.
